What are the steps to a fair trial? What is the importance of the court cases Goss v. Lopez and Dixon v. Alabama in maintaining a well-ordered school? The due process steps are before a student can be suspended from school due to a wrongdoing; they must be afforded the right to an informal hearing discussing the allegations and evidence against them that led to a disciplinary suspension. Additionally, if a student faces expulsion, he or she has the right to a formal hearing before a neutral body and can have an attorney who can question witnesses. Additionally, students facing these disciplinary actions have the right to remain silent and not have to answer any questions without an attorney. In the case of Goss v. Lopez, a student sued because an Ohio law allowed a school principal to suspend a student for 10 days. or more with a simple 24 hour notice to parents. The court ruled that this was a violation of a student's 14th Amendment due process clause rights because the students were not given a due process hearing. In the case of Dixon v. Alabama, a federal appeals court has affirmed the same standard in higher education by holding that a public college or university cannot expel a student without a hearing. These cases and due process standards allow for the protection of students within the school and ensure that students' constitutional rights do not stop at the school gates. Additionally, these cases ensure that administrators run schools fairly and consistently and do not arbitrarily discipline students without due process. Furthermore, they should provide leads and information to relevant police investigation units and take action against unauthorized persons within school property.
